O dever de assistência dos filhos aos pais em situação de velhice : a obrigação de alimentos

Abstract

As constantes mutações nas estruturas familiares e o envelhecimento da população são um dos grandes problemas do século XXI. Conforme iremos abordar, as alterações da sociedade provocaram mudanças no seio familiar originando um grupo vulnerável, necessitando assim os idosos atualmente de cuidados acrescidos. Tendo em conta o cenário atual é importante falar da proteção do Idoso, pois, tais alterações, provocaram um aumento exponencial da população idosa e consequentemente o corte de laços na filiação, o que implica necessariamente, que o nosso sistema jurídico determine respostas, de forma que os “pais” idosos não fiquem desemparados e abandonados pelos filhos adultos. Assim a presente dissertação tem como principal objetivo estudar quais os deveres jurídicos dos filhos para com os pais idosos, e abordar detalhadamente a obrigação dos filhos em prestarem alimentos aos mesmos. Na relação entre pais e filhos afiguram-se três deveres importantes. O dever de cooperação, o dever de assistência e o dever de auxílio. Estes deveres são bastante reconhecidos e aplicados quando se trata da relação entre os progenitores com os menores. No entanto, conforme dispõe o artigo 1874º do Código Civil, esses deveres são recíprocos, cabendo a sua aplicação no inverso: entre filhos e progenitores. Em suma, pretende-se abordar as diversas problemáticas inerentes as obrigações dos filhos para com os pais, concretamente a obrigação de alimentos e as suas consequências no caso de recusa, assim como a responsabilidade civil e criminal dos filhos e, consequentemente na falta destes qual o papel a desempenhar pelo Estado.

The constant changes in family structures and the aging of the population are one of the biggest problems of the 21st century. As we will discuss, changes in society have caused changes within the family, creating a vulnerable group, thus requiring the elderly to receive increased care. Taking into account the current scenario, it is important to talk about the protection of the Elderly, as such changes have caused an exponential increase in the elderly population and consequently the cutting of ties in affiliation, which necessarily implies that our legal system determines responses, in a that elderly “parents” are not left helpless and abandoned by their adult children. Therefore, the main objective of this dissertation is to study the legal duties of children towards their elderly parents, and to address in detail the children's obligation to provide maintenance to them. In the relationship between parents and children, three important duties appear. The duty of cooperation, the duty of assistance and the duty of aid. These duties are widely recognized and applied when it comes to the relationship between parents and minors. However, as provided in article 1874 of the Civil Code, these duties are reciprocal, and they must be applied in the opposite way: between children and parents. In short, the aim is to address the various issues inherent to the obligations of children towards their parents, specifically the obligation to maintain food and its consequences in the case of refusal, as well as the civil and criminal liability of children and, consequently, in the absence of these, which the role to be played by the State.
