Fake News e a Internet : o combate à desinformação

Abstract

A pesquisa terá como objeto de estudo as pessoas físicas e jurídicas envolvidas na propagação de falsas notícias as “fake news”. A pesquisa será classificada como bibliográfica, ao passo que ela será desenvolvida tendo como base materiais elaborados por outros autores que já foram publicados, seja em livros ou trabalhos científicos que tenham sido publicados nos últimos anos, adquiridos e coletados de forma não onerosa. O objetivo será discutir a possibilidade jurídica de responsabilização do indivíduo pela criação ou propagação de fake news e desinformação em geral, tendo como base as leis cíveis em vigor. Existe uma crescente preocupação com as fake news, dado que ofendem a honra das pessoas e podem causar danos a longo prazo em razão da dificuldade em eliminar as suas consequências. Sobre o dano, nestas situações, o mesmo assume características particulares no dia a dia da vítima deste tipo de notícias, atenta a facilidade da sua difusão pela Internet, por qualquer utilizador das redes sociais e/ou por sites de notícias, e, consequentemente, em qualquer lugar do mundo. A configuração da responsabilidade civil no âmbito digital, em decorrência de fake news pode consistir na criação de legislação específica para punição do agente. Ademais será considerado todo o ordenamento jurídico já existente, a partir do que se tem previsto acerca da responsabilização civil e responsabilização digital, de modo que as Fake News também deverão ser passiveis de condenação no sistema que já se encontra em vigor. Utilizaremos o termo “Fake News” para tratar as notícias falsas.

The research will focus on individuals and legal entities involved in the spread of false news or "fake news." The research will be classified as bibliographic, developed based on materials created by other authors that have already been published, either in books or scientific papers published in recent years, acquired and collected at no cost. The objective is to discuss the legal possibility of holding individuals responsible for the creation or dissemination of fake news and misinformation in general, based on existing civil laws. There is a growing concern about fake news as they offend people's honor and can cause long-term damage due to the difficulty of eliminating their consequences. Regarding the harm in these situations, it takes on particular characteristics in the daily life of the victim of this type of news, given the ease of its spread on the Internet by any social media user and/or news websites, and consequently, anywhere in the world. The configuration of civil liability in the digital sphere, due to fake news, may consist of creating specific legislation for the punishment of the agent. Furthermore, the entire existing legal system will be considered, based on what is foreseen regarding civil liability and digital responsibility, so that fake news should also be liable to condemnation in the system that is already in force. We will use the term "Fake News" to refer to false news.
