Comunicação sobre o direito europeu de proteção consular e diplomática

Abstract

Para além de representar um direito fundamental de cidadania, a proteção diplomática e consular europeia retrata a política internacional da União. A proteção consular e diplomática europeia está, contudo, sujeita a variações, que dependem da prática e da legislação de cada Estado-membro. Essa comunicação pretende colaborar no esclarecimento dessa liberdade, considerada particularmente inovadora. Valendo-se do método hipotético dedutivo, buscamos apresentar o direito europeu de proteção consular e diplomática interligado ao princípio da não discriminação em razão da nacionalidade. Percebemos que o direito europeu de proteção consular e diplomática já nasceu subordinado ao princípio do direito ao direito. Que é o principal instrumento de execução dos Direitos Humanos. O futuro da cidadania da União depende, entretanto, de uma integração ainda maior entre os direitos fundamentais da União e os direitos constitucionais dos Estados-membros.

In addition to representing a fundamental right of citizenship, European diplomatic and consular protection reveals the Union’s international policy. European consular and diplomatic protection is, however, subject to variations, which depend on the practice and legislation of each Member-state. This communication intends to help clarify this right, which is considered to be particularly innovative. Using the hypothetical deductive method, we seek to present the European law on consular and diplomatic protection linked to the principle of non-discrimination based on nationality. We realize that the European law on consular and diplomatic protection was born under the principle of the right to the right. Which is the main instrument for the enforcement of human rights. The future of Union citizenship, however, depends on an even greater integration between the fundamental rights of the Union and the constitutional rights of the Member States.
