Nos 60 anos da Declaração Universal dos Direitos do Homem : uma perspectiva portuguesa

Abstract

0 presente artigo referencia os acontecimentos históricos que deram origem à Declaração Universal dos Direitos do Homem e esclarece o seu valor como documento de direito internacional. Numa segunda parte sumaria a perspectiva com que Portugal encarou a Declaração até 25 de Abril de 1974 e a sua atitude posterior. Finalmente identifica os passos principais que levaram a aprovação do art. 16.Q n.Q 2 da Constituição da República Portuguesa de 1976 e esclarece que a sua ratio vem a ser triplice: clarificar e alargar o catálogo de direitos, reforçar a sua tutela e abrir horizontes ao universalismo.

The present article makes reference to the historical events that led to the origin of the Universal Declaration of Human Rights and clarifies its value as an International Right document. In a second part, it summarizes the perspectivewith which Portugal faced the Declaration until April 25th 1974 and its later attitude. Finally, it identifies the main steps that led to the approval of the article 16th n.Q 2 of the Portuguese Constitution of 1976. It also clarifies its three sided ratio: clarify and extend the rights catalogue, strengthen its guardianship and open the universal horizons.
