El tráfico de influencias : marco normativo internacional

Abstract

En el presente trabajo se examinarán las disposiciones previstas en los instrumentos internacionales anti-corrupción en materia de tráfico de influencias, para determinar el ámbito de aplicación del delito en el contexto internacional. Asimismo, a partir de dicho análisis, se aludirá a algunos de los desafíos que plantea la regulación penal de esta clase de conductas.

The main goal of this article is to highlight the different forms of trading in influence in the main international conventions and protocols in order to provide a picture of the most important aspects of the issue. By examining the respective provisions, it will be possible to test whether they provide an effective solution for scrutinising this phenomenon, as well as to identify the different approaches to criminalisation.
