Responsabilidade civil na indústria farmacêutica : em particular no caso de interações medicamentosas

Abstract

O presente trabalho tem como objeto o estudo acerca da imputação da responsabilidade civil da indústria farmacêutica no caso de produtos defeituosos, com especial enfase nos casos de interação medicamentosa. Não se pode asseverar que numa análise sistemática das normas em vigor não se encontre solução para o problema, todavia, será ferramenta suficiente para o lesado? Desta forma, pretende-se, ao longo do desenvolvimento deste trabalho, encontrar e posicionarmo-nos sobre o que se entende por solução justa e razoável para que o lesado tenha possibilidades de transferir o dano sofrido aos prováveis lesantes – baseando-se, sobretudo, numa solução de inversão do ónus da prova, sem que, para isto, sejam desrespeitados os limites impostos pelo instituto da responsabilidade civil.

The present study has as object the study about the imputation of the responsibility of the pharmaceutical industry in the case of defective products, with special emphasis on the cases of drug interaction. It cannot be alleged that a systematic analysis of the rules in force does not lead us to a solution to the problem, but will it be a sufficient tool for the injured party? In this way, it is intended, throughout the development of this work, to find and position ourselves on what is a fair and reasonable solution so that the injured party has possibilities to transfer the damage suffered to the probable tortfeasors - based, above all, on a solution of inversion of the burden of proof without disrespecting the limits imposed by the Tort Law.
