Abstract

Caro leitor nesta Tese que agora lhe apresentamos poderá ter acesso ao exaustivo estudo da realidade atual dos atores em Portugal. O estudo que agora começa será o mais completo possível indo desde as raízes destes profissionais na sua génese mais profunda até aos tempos atuais, depois terá lugar a uma comparação exaustiva e construtiva, igualmente será uma viagem pelos grandes preceitos legais que o estiveram sempre a proteger até á trilogia 2008, 2009 e 2011, aos quais iremos apontar certas fragilidades encontradas através não só do estudo dos próprios diplomas legais, bem como de entrevistas aos profissionais com grande experiência em diversos meios de trabalho, teatro, dobragens, cinema e televisão, que trazendo cada um a sua visão única que vale apena ser lida nos conduziram pelos problemas deste sistema e seus agentes motores e o seu real posicionamento e papel neste setor… Contudo por se tratar de uma realidade complexa não nos ficaremos apenas pelo ramo dos contratos enquanto objeto jurídico, vamos relaciona-los com outros ramos do direito e com outras realidades que também contribuem para o estado atual deste sistema contratual, ligado a esta profissão e para as condições reais e de vida dos atores, passaremos por tópicos frágeis como a entrada na carreira profissional, o desemprego, a doença, os Direitos conexos, a relação com o Estado, a situação do teatro hoje. Será um estudo de linguagem acessível a todos próximo da realidade, tendo como objetivo a defesa e o bem-estar da figura do ator em termos jurídicos tudo para que o caro leitor entenda melhor certos aspetos que desenvolvem, depois reflexos nos contratos na realidade atual, e porque se afirmou certas coisas sobre esta profissão… será um estudo franco, sem medos, que aponta as fragilidades e também aponta soluções, também iremos ver como a lei estrangeira olha os seus atores e a arte, tudo isto para que fique com o melhor entendimento do tratamento do ator em Portugal e o seu papel na sociedade, para os contratos e como agentes de direito, esperamos que goste desta viagem e que saia dela com uma visão o mais clara possível.

Dear reader, in this thesis that we are going to present you, you may have access to the exhaustive study of the reality of the actors in Portugal nowadays. The study that is about to begin will be as complete as possible, referring some aspects from the beginning of this profession up to the present times. Then an exhaustive and constructive comparison will be done; we will also go through the great legal precepts that have always been protecting actors until the trilogy years of 2008, 2009 and 2011, where we are going to point out certain weaknesses found, not only through the study of the legal diplomas, but also through interviews made to the professionals with great working experience in different areas: theatre, dubbing, cinema, television. It is worth to read the unique statements given by each professional, where they focus the problems they had to face, the problems of this system and the way this system works, as well as their real position and role in this sector. However, as this is a complex reality, we will not just be concerned with the contracts as a legal object; we will relate them to other branches of law and other realities linked to this profession, which also contribute to the state of the current contractual system and to the real living conditions of the actors. As this is a close study of reality, aiming at the defense and well-being of the actor, in legal terms, we want you, dear reader, to understand certain aspects in the current reality and explain you the reason why certain things have been said about this professionals. We will go through some realities, such as unemployment, disease, copyright related rights, the true power of television and its agents; the mismatch of the law with the day-to-day reality in the different fields of this system. This will be a honest and fearless study that will point out not only the weaknesses, but also some solutions. We will also see how foreign laws look at their actors and the way we can follow, in Portugal, so that these professionals may be treated as they deserve, having an important role in the society and having the right contracts.
