Condições de encarceramento e a crise estrutural do sistema prisional brasileiro

Abstract

Entendendo as prisões como elemento constitutivo do sistema capitalista, e utilizadas com a função de estocar grande parcela da população, não é de se espantar que as instituições penitenciárias também estejam passando por crise estrutural. Daí porque, o presente texto tem como objetivo conhecer as condições de encarceramento das instituições prisionais, usando o município de Ituiutaba/MG, como exemplo, estabelecendo comparativo da realidade encontrada com a que está previsto em lei, bem como, construindo nexos das condições de encarceramento do município com a realidade das instituições prisionais brasileiras. Utilizou-se de pesquisa bibliográfica, documental e empírica, aprovada pelo Comitê de Ética em Pesquisa Universidade Federal de Uberlândia. A realidade encontrada na instituição-cenário da pesquisa não é única, se estendendo ao território nacional, tanto no perfil das pessoas que estão encarceradas, como na condição de aprisionamento, em situação de crueldade e degradação da vida humana, que representa grave violação de direitos.

Understanding prisons as a constitutive element of the capitalist system, and used with the function of storing a large portion of the population, it is not surprising that penitentiary institutions are also undergoing a structural crisis. That is why, this text aims to know the conditions of incarceration of prison institutions, using the municipality of Ituiutaba/MG, as an example, comparing the reality found with what is provided for by law, as well as building nexuses of the conditions of incarceration of the municipality with the reality of Brazilian prison institutions. A bibliographic, documentary and empirical research was used, approved by the Research Ethics Committee at Universidade Federal de Uberlândia. The reality found in the research institution-scenario is not unique, extending to the national territory, both in the profile of people who are incarcerated, as in the condition of imprisonment, in a situation of cruelty and degradation of human life, which represents a serious violation of rights.
