Sociedade, governança e manifestações criminais sobre a forma de crime organizado : conhecer para intervir

Abstract

O presente artigo incide sobre a relação entre a problemática do crime organizado e o modelo de governabilidade da sociedade portuguesa. Inicia-se a abordagem da problemática sobre a criminalidade organizada através de um enfoque histórico e evolutivo da governabilidade da sociedade portuguesa do século XX, na transição para o novo milénio. Expõe-se o modelo de governança sobre os sistemas de justiça, e de segurança, identificando algumas das ameaças criminais que marcaram a história recente. É a partir da definição do conceito de grupo organizado, na aceção da Convenção de Palermo, e as características da sociedade portuguesa, e das sociedades europeias, que se exploram as ameaças do crime organizado sobre o espaço europeu, de segurança, liberdade e justiça. Apresentam-se alguns produtos de "intelligence" que procuram identificar o quadro da ameaça; no plano nacional através do Relatório Anual de Segurança Interna (RASI), e no plano europeu mediante o "Serious and Organized Crime Threat Assessment" (SOCTA). Culmina-se com a evidenciação de alguns dos dispositivos e instrumentos legislativos e técnicos de prevenção e repressão sobre o fenómeno, assim como com a enunciação de alguns dos sistemas e mecanismos de cooperação entre operadores que intervêm no domínio do controlo social formal.

This article focuses on the relationship between the problem of organized crime and the governance model of Portuguese society. The approach to the problem of organized crime begins with a historical and evolutionary approach to the governance of Portuguese society of the twentieth century, in the transition to the new millennium. It exposes the governance model of justice and security systems by identifying some of the criminal threats that have marked recent history. It is from the definition of the concept of an organized criminal group, within the meaning of the Palermo Convention, and the characteristics of the Portuguese society, in the European context, that the threats of organized crime on the European territory as an area of freedom, security, and justice are explored. Some intelligence products that address the threat framework are explored; at the national level through the Annual Internal Security Report (RASI), and at European level through the Serious and Organized Crime Threat Assessment (SOCTA). The approach is completed with the disclosure of some of the legislative and technical provisions and instruments of prevention and repression on the phenomenon, as well as the identification of some of the systems and mechanisms of cooperation between operators that intervene in the field of formal social control.
