Actualidade do catálogo de fontes de direito consagrado no código civil de 1966

Abstract

O presente texto compreende a análise de dois aspectos acerca do catálogo de fontes de Direito consagrado no Código Civil português. Assim, num momento inicial indagamos se o binómio lei e norma corporativa foi a solução mais acertada ao tempo da sua consagração neste diploma para num momento subsequente aferirmos da actualidade da mesma solução em virtude da nova ordem constitucional. O Código Civil português consagra as leis e as normas corporativas como fontes imediatas de Direito, o costume como fonte mediata e, na sua versão inicial, conferia também esta natureza à jurisprudência. O elenco positivado pelo legislador de 1966 não correspondia sequer à realidade existente em 1966 porque omite os regulamentos e as convenções colectivas de trabalho, aos quais era conferido o valor de fonte de Direito por força de outros diplomas. A entrada em vigor da Constituição da República Portuguesa agravou a desadequação do Código Civil à realidade portuguesa na medida em que a nova ordem constitucional outorgou à própria Lei Fundamental a qualidade de única norma normarum do ordenamento jurídico português. A pesquisa de normas legitimadoras de fontes de Direito na nova Constituição formal permite a renovação do catálogo nos seguintes termos: a própria (i) Constituição, o (ii) Direito outorgado, isto é, os actos legislativos, os actos regulamentares, os regulamentos europeus, as directivas europeias e eventualmente normas provenientes de outras organizações internacionais de que Portugal seja parte, o (iii) Direito pactuado, que compreende as convenções colectivas de trabalho e as convenções internacionais e algumas (iv) decisões jurisprudenciais.

This paper includes the analysis of two aspects about the catalog of sources of law enshrined in the Portuguese Civil Code. Thus, in a start moment, we inquired whether the binomial law and corporate norm was the most accurate solution at the time of its consecration in this diploma for a subsequent moment to assess the timeliness of the same solution by virtue of the new constitutional order. The Portuguese Civil Code enshrines laws and corporate norms as immediate sources of law, custom as a mediate source and, in its initial version, also conferred this nature on jurisprudence. The 1966 legislator’s list did not correspond to the reality existing in 1966 because it omits executive norms and collective labor conventions, which were given the legal value of the law by effect other legal instruments. The entry into force of the Constitution of the Portuguese Republic aggravated the inadequacy of the Civil Code to the Portuguese reality insofar as the new constitutional order granted to the Fundamental Law itself the quality of the only norm normarum in the Portuguese legal system. The search for norms legitimating sources of law in the new formal constitution allows the renewal of the catalog in the following terms: the own (i) Constitution, (ii) the Law granted, that is, legislative acts, executive acts, executive european acts, european directives and possibly standards from other international organizations of which Portugal is a party, the (iii) agreed Law, which includes collective labor conventions and international conventions, and some (iv) case-law decisions.
