Direitos humanos e historicidade : uma problematização a partir da filosofia de Gilles Deleuze = Human rights and historicity : an investigation through Gilles Deleuze´s philosophy

Abstract

O objetivo do presente artigo consiste em investigar, no contexto da filosofia de Gilles Deleuze, possíveis elementos que nos auxiliariam a pensar os direitos humanos e os seus problemas. Parte inicial das dificuldades de nossa leitura consiste nas considerações que o autor faz no tocante à própria relevância dos direitos humanos para a transformação de circunstâncias específicas e resolução dos problemas das comunidades em particular. Em outras palavras, correm o risco de serem apenas abstrações destituídas de consequências normativas significativas. Entretanto, intérpretes como Alexandre Lefebvre e Paul Patton apontaram elementos, sobretudo nas obras tardias do autor, que abrem espaço para cogitarmos uma filosofia política atravessada por inclinações utópicas. A ideia central deste trabalho consiste em afirmar que seria viável, através dessa filosofia política observada na obra do autor, conceber os direitos humanos como manifestações imanentes de um devir histórico ao invés de elementos jurídicos transcendentes que se sobreporiam às múltiplas instâncias particulares abertas por esse devir.

The main purpose of this theoretical article is investigate, within Gilles Deleuze´s philosophy, possible elements that would be relevant to think Human Rights, its limitations and problems. An initial hindrance would be the explicit remarks that Deleuze made regarding the wholesome abstraction of human rights, something that makes it of little value to solve the particulars problems of specific communities. In other words, human rights are very close to being abstraction without any legal effectiveness. However, scholars such as Alexandre Lefebvre and Paul Patton pointed out elements in Deleuze´s latter writings that would discloses a political philosophy deeply marked by utopian considerations. The key idea of this article is that would be reasonable to regard, within that political philosophy, the human rights as an immanent by-product of historical flux instead of transcendent rights that would be above the mentioned historical flux.
